General sales and delivery conditions

By placing an order, the buyer accepts the general terms and conditions of alfavet Tierarzneimittel GmbH. Other general terms and conditions that have not been agreed in writing will not be recognized.

1. Prices

The offers are non-binding with regard to price, quantity, delivery time and delivery option. The prices we quote are net prices plus statutory VAT. If the buyer requests a separate shipping method, the additional costs will be charged. For an order value of less than 150 euros, proportional postage and shipping costs of 15 euros will be charged. When shipping medicines, a surcharge of 3 euros will be charged if the value of the goods is less than 350 euros.

2. Delivery

All shipments are insured against transport damage and loss at the buyer's expense. Shipments that are expressly uninsured are delivered at the buyer’s risk. A surcharge will be charged for shipping refrigerated goods depending on the size of the delivery. The shipping method and route are chosen by the seller; there are no fixed delivery times. The seller is entitled to make partial deliveries. The risk of deterioration and loss of the goods passes to the buyer as soon as the goods have been handed over to the transport company.

In the event of force majeure and other unforeseeable circumstances beyond our control, even if they occur at a pre-supplier, the seller is released from compliance with the delivery deadline. As a result of the disorder, the delivery or acceptance exceeded by more than eight weeks, both parties are entitled to withdraw.

3. Returns

Only undamaged, originally packaged, unlabeled and unglued goods will be taken back. For medicinal products, a return form must be completed (Ordinance for Pharmaceutical Wholesalers Section 7b). The goods must be packed carefully and unbreakably in a transport box.

4. Notifications of defects

Visible defects must be reported in writing immediately, but at the latest within 8 days of handover of the goods. The buyer's claims for defects are limited to the right to supplementary performance. The seller is not obliged to store, return or reimburse returned goods, but reserves the right to destroy the goods in the interest of product safety, excluding any claims for compensation.

5. Payment

The invoices are payable within 14 days without deductions. If direct debit is agreed, we grant a 1% discount if debited within 14 days. In the event of late payment, default interest of 8% above the base interest rate will be charged. We reserve the right to prove greater damage in individual cases. During the delay, the seller is not obliged to execute further orders.

6. Retention of title

The goods remain the property of alfavet Tierarzneimittel GmbH until full payment has been made. If reserved goods are resold, the resulting purchase price claims are deemed to have been assigned to us. Until payment has been made in full, the goods may not be transferred as security or pledged to third parties.

7. Application

Advice given to the buyer by the seller, verbally, in writing and through visits, is provided to the best of our knowledge, but is only considered as non-binding advice and does not exempt the buyer from examining the goods themselves to determine their suitability for the intended processes and purposes.

8. Data protection

The use of customer data takes place in strict compliance with the applicable data protection regulations. Our data protection declaration is published on our homepage www.alfavet.de.

9. Place of performance and jurisdiction

The place of fulfillment for delivery and payment is the headquarters of alfavet Tierarzneimittel GmbH in Neumünster.
